This is an area I've never really looked at but someone looking to defend against a claim might want to do more research into it.

If a debt purchaser purchases a debt for say 10% of the face value, then chases for 100% + 8% Statutory Interest could this be classed as an attempt at Unlawful / Unjust enrichment - might even come under the Unfair Relationships sections 140 a - d of the Consumer Credit Act, could it be used in a defence against a debt purchaser claim.

Imo even asking for the full 100% is unjust, but they would not view it like that I'm sure, the purchaser is purchasing a right to the debt ergo the debt is what is due. However additional interest..... Wouldn't interest be part of an agreement, i.e 10%, 15%, 20% and this is agreed before accepting. SO if a purchaser has no right to any benefit of an agreement unless they are a named party for that benefit, how are they due statutory interest, and what 'statute' enacts this, if 'statutory interest' is not just a useful term for them.

to understand better her is a brief and usually unreliable overview from wiki, but useful to begin to get our heads around it.

The English law of unjust enrichment is part of the English law of obligations, along with the law of contract, tort, and trusts. The law of unjust enrichment deals with circumstances in which one person is required make restitution of a benefit acquired at the expense of another in circumstances which are unjust.

I wonder how versatile this could be, certainly in relation to securitisation.

I know its wiki, but here it says that its in relation to contracts, tort, and trusts...... Is there a contract with a purchaser? Then in equity this could be a very useful tool.......

Totally Unrelated, BUT.
I notice the old site,
when I look,
keeps showing these POP up Notices , that say things like
ANGUS just rearranged his debt 4 minutes ago.

If these notices were fake ,
Which they undoubtedly are.
Could it be possible to make some kind of Consumer Complaint
for Misleading advertising ?
