I am new-ish

Hi All,

I am new here but was part of the old GOODF site. It seems that the content we all created last time has vanished now.

My big story was that I overturned about a 3K claim from Bryan Carter using the three letters, as well as a certain approach to court. If I can remember I went through the standard procedure- asking to view documents, challenging them to prove, but in the end I got proactive with the civil procedure rules and applied to strike out Bryan Caretr's claim as they had not responded in time, at which point BC dropped matters and the alleged debt is now Statute Barred.

The best advice I can give is that as any old alleged debt approaches 6 years the DCAs will start to hound you, but don't worry. They ramp up the pressure because they've got no right to get money out of you. The court papaerwork is a con to scare you, if you scratch the surface with it they will back down. Northampton Bulk Claim Centre isn't a court, it's basically just a printer

Northampton Bulk Centre is a Court as it has Judges and takes its Jurisdiction from them, no one should ever be mistaken in the belief that this isn't a Court and ignore papers sent to you.

Any Court papers ignored will lead to a Judgement by Default which is an absolute gift to any DCA Claimant.

Also, 2Powerwashing, did Bryan Carter send you a Notice of Discontinuance?

You're right Tiggy. It's true what you say, that people shouldn't ignore court papers, but you also need to see them as the DCAs just ramping up their tactics and not get intimidated by it. Anyone can claim anything off anyone through Money Claim Online, the evidence (if there is any) isn't heard by a judge until the 11th hour so it's all just a paper exercise to intimidate you into paying up until that point.

No the court gave them a deadline to respond with something I had asked for (inspection of documents I think), the whole story has been lost on the old site, anyway they did not respond to the court and I have heard nothing since. The whole thing is statute barred now.

Unless they have Discontinued the claim it may be Stayed (halted). Did the Court issued an order saying it would be struck out if they didn't comply with the request? If not, you might want to check what's happened to it.

If it is stayed, as they've already commenced proceedings then it cannot ever possibly be statute barred, unless they Discontinue or you apply for it to be struck out, then if it's gone beyond the 6 year time limit needed it will be Statute Barred.
