So as per title, i sold an item on ebay, used ebays postage thing which involves shutl, After which the item was taken to a parcel shop, shop handed item over and all tracking stopped after that due to a "parcel not scanned at parcelshop" message on tracking, heres what i have done,

Contacted ebay, shutl and hermes and so far they have all refused to help and have blamed each other, hermes have not even done an investigation as i got it confirmed from one chap that i actually managed to speak to on the phone.

All it takes is hermes to contact the driver and actually do an investigation to find out where this parcel is o.O

Anyway ebay have taken the money off me and still charging me the fees for the item so not only am i out of pocket from my lost/stolen item but ive also incurred £25 fees that ebay wants, plus the £20 odd ish phone bill due to calling around everyone.

Next thing i actually think is im going to have to go small claims but who against? ive got two different things going on here, ive got hermes who have lost my item,
ebay who are charging me fees for an item i didnt actually sell as they refunded the buyer (rightly so really) and shutl who gave me £25 compensation! this item is worth almost £300 £25 isnt going to cut it lol

So any one have advice etc? thanks!

If you have some form of proof of postage & value of item (your ebay sale will prove this & obviously double it as you have a buyer to refund as well as your own loss) then use the small claims court, i've used the small claims court before with success, claim against whoever lost the parcel.

Let them know first that you are going to do such, they may pay up.

You bring the claim against Ebay as you signed up with them, you sold the item on their site, you used their parcel delivery service which they appoint contractors such as Hermes, and you followed their delivery protocols.

Ebay are effectively the retailer and if they have an issue with their delivery contractirs and the systems they use it is up to them to deal with them and not you.

Okay still lost i have one person saying hermes another saying ebay lol this is where im stuck i need to get a letter together but im still abit uncertain as to whom i would be sending it too? ive got emails from all company's saying they wont help though! so ive got lots of proof especially from hermes stating they wont help me hermes say its down to ebay as the service was bought through them, ebay says its down to shutl as they are the ones who provide the service and shutl saying they will refund me £25 compo o.O

I agree with assassin,

The only one that is charging you for any service is ebay .Therefor any claim should be against ebay.

So i should take it up with ebay? or shutl? im under the impression its down to hermes to find the parcel but, shutl sold the service to me, so shutl is owned by ebay correct?

I used the site and yes followed what i need to then the item went missing, ebay are currently not moving and still refusing to help.

Sorry i have no idea what company owns what. I am presuming only one of the above has been paid by you ,so that would be the one to make a claim against.
Whatever contracts they have with each other is not your concern. On that presumption if you paid ebay ,then ebay is in breach of their contract with you by failure to complete the contract terms.
If they wont budge try the threat of court action.

So i actually did try the threat of court action on the phone pointed out how they had failed to instigate an investigation etc

Still were not interested, ebay basically say that because i failed to provide proof of delivery its my problem and that its down to me to make sure the item reaches the buyer.

Problem is how am i meant to do anything when i bought the service through them and only they can get an investigation started?

So i pointed this out to which i was told again they cannot help me as its nothing to do with them, actually this is the exact line used,

"At this point, I suggest that you contact the courier as you may be able to file for compensation as the receiver of the item stated that they haven’t received the parcel."

I spoke to someone and explained this wasn't about making the buyer pay up it was about ebay paying up as they kept assuming i wanted to appeal against the buyer, i did tell them this was not the case.

So it would seem i need to make a small claims against ebay? Do i even have a chance of winning that o.O how would i even start a letter etc....Sad

Yes you do, basically Fleabay are a large company and money and profit are their motives, if you bring a case against them they will take one look at it and make a decision on cost alone, and if your cost is much less than going to court for Fleabay then they will concede.

What have they tried to do so far? they have tried the blame game and tried to confuse you, its failed, they tried playing you against the buyer, it failed, so basically all their diversionary tactics have failed.

Next you do your research, you find out who owns herpes and prove fleabay own them, you keep all your corresponcence showing all their tricks and diversionary tactics, and you create your list of charges. This list of charges should include the time you have wasted on this case, the vehicle journeys, the cost of phone calls, and even any written correspondence you have sent. From this you compile your own list and give them a charge.

I dont know who owns hermes and i cant find anything that suggests that ebay owns them?

I do know ive incurred lots of costs and wasted time due to this though! (phone bill is going through the roof now)

There is alot that has been done on the phone that i cannot remember all of it but i have kept the emails, messages on face book etc (to hermes)

And what of the measly £25 that shutl gave? i never accepted that it was just given to me as "compensation"

Its all getting really confusing now.

What i have found sometimes works is to send a copy of county court claim and tell them that unless they provide a positive response within 14 days that you will commence with the claim against them. Download a claim form and fill it in.
I will show them that you have the claim ready to go.

Thats a lot of information that just went right over my head haha.

Now something i should point out is i have prevented ebay from actually taking any of this money from my bank, its in a "negative" paypal balance, so ive technically not lost any money as of yet, so with regards to taking things further do i need to word it any different etc?

In simple terms?

Herpes have four directors as listed above.

Herpes have one significant person in control which is Gratton catalogues who are listed as Gratton PLC who own a controlling interest of 75% or more in Herpes, and effectively own and control Herpes, so Gratton owns and runs Herpes as an individual company and the directors of Gratton are actually liable through this controlling interest.
