Hi what should my response to this be got this after sending first letter.

Lowell does not accept any unilateral terms and conditions, deadlines, or charges outlined in your correspondence.

As my colleague advised we have requested a statement and credit agreement from the original creditor. which fulfils our obligations under Sections 77-78 of the Consumer Credit Act 1974. We consider these documents as sufficient evidence of your liability for this debt and will contact you when we hear back from New Day / Aqua.

The account remains on hold until these are received.

I’m relatively new so someone else may correct me but my understanding is that unless they send you the documents that you ask for you carry on with the letters to completion. I also added in my second letter to Wescot something along the lines of “the person who conducted due diligence would surely have ensured that all the requested documents were present before your started your claim against this alleged debt. I also remind you that I require the name of that person”. My second letter was returned with a note saying they were no longer acting on the OC’s behalf and would I kindly direct all my enquiries to them.

Welcome magoo,

Just wait ,do not rush things ,when next letter is due just send it.
You could also let them know that you will not be accepting their terms & conditions,(it works both ways)

Agreed, carry on with the letters. Even IF they sent you a true copy of the CCA and Ts & Cs, so what? It means you took out a CC or loan some time in the past. That’s NOT a Debt... For all they know, you could have paid it off - and hence why we ask for all the other documents that we are perfectly entitled to see, end of Wink
