urgent ....help needed .......please

i have been issued with a final notice this morning from MARSTON HOLDINGS?
please bear with me its a little complicated ..
apparently a car i gave my son traveled through a bus lane and recieved a £30 fine
i was unaware of this as son did not want te earache from me i guess?
i informed dvla of the keeper change but there seems to be a time lapse of when this was done ?
anyway this fine was in my name. i presume son left it for a while hoping it would just go away?
but offered to pay but was told by Marston holdings they would have to speak to me 1st?
As he didnt want me to know this was then left again.
So this morning i left for work and got a message from wife saying marston holdings have been and are coming back tonight to remove goods or pay £408?
i phoned and explaned to them the situation and it was lie talking to a brick wall ...so i phoned there office... same outcome .
i told them i have an elderly mother who is end of life and bed bound .
and will not be allowing them into her home .
after a few heated words i hung up on them .
i then recieved a message saying as a GESTURE they will put off the ENFORCEMENT until tommorow midday.
but the ENFORCEMENT WILL STILL PROCEED UNLESS PAYMENT IS RECIEVED .
how do i get these parasites off my back ?
i plan to call the council tomorow and explain to them the situation .
marston holdings said i could phone who i wanted it will not change the situation
also my son phoned them and offered to pay the £30 -refused
he then said he would pay the £408 but would pay £5pm -refused
can i also note the supporting video clearly shows my son driving the car and he has admitted this .
but as marston holdings are saying there not bothered if the queen was driving it the car was in my name at the time of offence

Marstons are a bunch of see you next Tuesdays...

DO NOT let them in DO NOT open a door they CANNOT force entry & get any vehicles away in a locked garage or away from your property.

I'm sure you will get more help here to deal with things further but the above are your first actions.

Doesn't matter what they've got they are private bailiffs in a civil matter not court bailiffs (TV propaganda makes people believe all bailiffs are the same & can force entry) if you don't open the door they can do Jack s**t.

Good luck with the council but remember they are all criminal gangs.

Take the above advice. Phone their office (record the call if you can) and inform them there is a vulnerable
person in the house & if they enter or attempt to enter they are on notice that they will be held personally
responsible for any consequences .
I would also contact the court & find out what amount the fine was including costs . Pay that to the council
direct, I would not pay marstons a penny ,I would bet at least half of that amount is their charges,& you have no contract with them.

it was a £30 fine from the council for encroaching a bus lane
i will be phoning the concil tomorow to see if i can pay them
i phoned Marstons office and explained the situation with the old lady
and he just said there was nothing he could do but the officers are trained to deal with situations like this ?
that is when i got a little shirty with them and hung up the phone

Make sure you put them on notice . Use the words " you are now on notice & personally liable"
Important you record your conversation with the council as they will no doubt try to say you must
deal with Marstons, Should they say that you then ask them if they are refusing payment.

Ok update the council refuse to listen will not accept payment....have to deal with marston's?
When asked for name as I am recording the conversation he said I didn't ask for Permission for that and said end of conversation and hung up?
Will this marston payment keep escalating? And will I end up having to pay regardless?
They are due to call again in 2hrs ?

Ok, First thing ,remove car from vacinity ,make sure doors & windows are locked .Under no account open the door,
record everything.
As the council refuse to discuss on the phone . Send email requiring the name of the employee who states
they are refusing payment. point out you have no contract with Marstons and will not make payment to them.
Remind the council that if they refuse the payment the debt no longer stands.
Also email Marstons with what I posted yesterday regarding the vulnerable person & their liabilities.

Do this now.

Regarding this matter .
Unfortunately we had to throw the towel in and pay to stop these legalized thugs .from harassing us .I couldn't risk them clamping my car or putting the fear of God in mother.
How these evil b*stards sleep at night I don't know . Thanks again for the support

Thanks for the feedback, There is nothing wrong if you feel you had no choice,causing you stress is all part of their tactics .
Now its over you could if you wish ,start a complaint against the bailiffs for threats of entry whilst a vulnerable
person is in the premises. Also still demand who from the council refused payment.You have nothing to lose
so why not start demanding answers ?

Take a look at taking civil action against the council & very much those sh*tbags Marstons, the fees they add are often illegal, go through with a fine toothcomb all paperwork you have etc, do some research & seek help here.

As much as i understand the upset & how you gave in but its easy for those outside your circumstances to criticise, see this as a learning curve in arming yourself with knowledge to fight this ongoing war against us.

I have made many mistakes & learnt to deal with the many criminal gangs i have dealt with differently & i have had success too, it's just a game to these vermin so play them at their own game.

Too much corruption there all in it together
I was reading yesterday this particular part of the bus lane is the UKs most lucrative.
It took in 2million pounds in fines in 12mths
So much si the introduced another which has taken £156,000 in the 1st 15 weeks of operation. This just boils my piss

Kestrel is right, They have harassed and extorted from you,now make it your turn & use this as a learning
experience.
Another question you could demand an answer to is ; Is this a publicly owned and maintained road ? If so
on what authority do they have to restrict its use to private corporations? (buses & cabs). These are public
servants ,they should answer to us.

Let me get this straight, you had a car and gave it to your son, he committed a breach of something and you got the PCN, yet the fault lay with the DVSA in Swansea as they didn't register the new keeper immediately and this delay meant you were registered as the keeper.

You gave them his details and they failed to pursue this matter? clear breach and failure of due diligence, you advised them you were a vulnerable household and they ignored this, clear breach Human Rights legislation of both EU and international.

Council refused to accept payment, then the alleged debt is no more.

I would suggest a good claims solicitor with good barristers as you have it all, and I would publicise this through as many media outlets as possible and highlight their fraud and corruption.
