Just received this reply from PRA
And I still have to send the 3rd letter.
I have noticed in the fact sheet (which I have searched for and cannot find).
PRA can contact me by phone. Surely an untruth as I requested contact by post
in the 1st letter? Another porkie pie spotted? (see underlined red in fact sheet)
Surely no signature and no date and reconstituted = a piece of paper?
Would a S.A.R. to OC help and one to PRA?

Well that makes me feel special, for the past 3 years the lovely Carissa has been offering to help me.
If I do not receive her monthly letter by tomorrow I shall be thinking she no longer cares,& it will
ruin my xmas.

Daveiron. They are trying to con you. Without providing you with the appropriate paperwork they are unable to pursue the debt or put anything ON YOUR CREDIT FILE.
They say in their letter they can "continue reporting this account on your credit file".

I am just going to amend the 3rd letter to PRA, ready to send in the next couple of days.
I hope their office do was none exsistant , as none of the alleged debts were collected.

Dave, why not ask her to come and cook your dinner and wash up afterwards if she wants to help you, then tell her the garden needs tidying which would also be helpful.

back end of last year successfully defended a parking ticket after the usual "discount" was offered. This is what I did & MAY NOT apply here.
Sent a very polite communique, to the effect: thanks for your offer to do business but here is the proof the ticket was paid in the 1st place so will not be taking up your offer.

Sorry just realised - they’ve said the debt is legally unenforceable? I would ignore them for now and see if they write to you again.
(Same thing happened for me and I’ve not heard from them for two years)

In my case (purely FYI wakey wakey) it was because even though PRA were able to send me a copy of the CCA, they didn’t have a copy of the default notice (which is what commonly happens).

Offering a discount is proof in itself that they have bought the alleged debt as a job lot and the OC (as in so many cases) cannot or do not have the paperwork and a huge discount still means they still make a profit.

Be careful. Offering a discount is a trick. The trick is to get you to "acknowledge" the debt and take up the offer. as soon as you have done so that offer is not available. Read the wording of the offer very carefully. Usually it says "May" be able to settle at a discount. Once you have "acknowledged" the debt you reset the limitation period to another 6 years.
If you want to "experience" what happens next, reply to such offers like "I don't recognise the debt, but need to clear paperwork and my time is valuable so I would like to take up your offer "WITHOUT PREJUDICE". It will not go through as there will be further correspondence getting you to further acknowledge the debt.
The other "trick" with unenforceables they use is time.They play on people "losing" and "forgetting" paperwork, and try it on years later, They do this even after they have failed in the county court. The debt never "dies". There is a letter you can send after the limitation period to say stop sending and you will never make any payments, but they still say the debt is still owed, maybe hoping one day for a change in the law in their favour. Again even after this letter they play on you forgetting in the future.
Incidentally if they have claimed a debt is unenforceable they are not allowed to put anything on your credit file (SOME INTERPRET THAT TO MEAN "WITHOUT THE WORDS UNENFORCEABLE".....i need to check that). If they do you can get damages to your credit rating. The Blackhorse case is relevent here.
The decision stems from an earlier case when District Judge Newman (Grace & Anor v Blackhorse: Chester County Court) ruled a credit agreement 'irredeemably unenforceable' and therefore William Grace did not have to pay.

Mongoose: that’s what we’re (assassin and I) are saying ie it’s a trick as for them, it’s better to get something rather than nothing esp when they can’t evidence a debt with the appropriate documents.

1) They offer you a discount as they know they don't have the paperwork to prove it - so getting something from you (a discounted amount) is better than nothing in their eyes (makes sense if you're them)
2) If you fall for this 'trick' i.e. start paying the discounted amount, you have acknowledged the debt so it's 'game over' for you i.e. you can no long rebut the claim etc.
