Solicitor's demand, wrongly addressed Empty Solicitor's demand, wrongly addressed

Post by scrwm Fri Jun 07, 2019 10:42 am

Hi goodf peoples,

I need to delay action by a creditor so I can make a plan to pay the debt off. Their solicitor sent a demand to my house, but the company registered address is not my house.

I am in the middle of end of tenancy where I am trying to arrange a new home. Things are a bit hectic here right now. If I can delay this solicitor by say 30 days until i move into my new home, I will be able to deal with his demand then.

Can i reply as the "Occupier" and inform them there is no company of such name registered at this address. Leaving it up to them to search for the company's registered address, which is a simple search for them to do. I have the company registered to an office in London, who are very good at the job and will not tell anyone where the shareholder or director lives. So that might create a little time for me to be able to deal with this.

The good news is really how goodf saved my ar*e so many times. Its literally helped me not pay out over £100k in debt over the years. From fighting bailiffs and all other nasty stuff goodf has literally given me strength to fight on. I have 2 bailiffs issues for coucnil that that are targeting me right now too. Not much aoi can do about that other than pay because in my experience those b*sturds just dont give up. I am right now this week at the point where I have rebuilt my business, signed some really great clients and literally days away from my first earned income in years. Had it not been for you guys I honestly think the outcome for me personally could have been terminal. I am very grateful.

Smile Smile

As you are intending to pay this ,it may be easier to inform them that if they agree to a payment
plan ,you will be in a postion to make payments in a months time.
They will know that any other route they may take will take much longer a month.

I would suggest you contact the creditor direct with that offer. Its in the solicitors interest to
escalate it & drag it out thus increasing his fees . That is not in your or the creditors interests.

I would go for two months because it gives you more grace and if they think they will get paid and you make a payment after 6 weeks instead of 8 weeks then it makes you look a better prospect for paying.
