Hi

Any advice would be great, I`m currently in the process of moving to south Wales on a peace of land I have bought. However I sold my flat 2 years ago and at first CDR group where threatening me via e-mail and gave up. Now jacobs seem to have got hold of my parents adress where I`m staying until I move full time to Wales.

They sent me two letter this morning I opened one sent the other back adressee unrecognised, just wondering if there`s any advice anyone could give me. Ideally I don`t really want them showing up at there property not that it bothers me too but with it not being my house its not something I really want happening, but I`m also not going to pay as they are after nearly £1800, if there was any arreas before I left it will have been like a couple of weeks.

they are going for the whole year most likely.

You could get the exact dates and make a full and final offer for the time you were there or

write to the DCA and ask that they bring the actual liability order issued by the court when they visit to evidence the authority they claim to act in this manner! (not just a NOTICE of the liability!!!)

Also ask them to include it with any letter they send you!

Any in person interaction ask to see the actual liability order , send them away if they dont have it on them or if they show you a notice or electronic copy of the notice. Photograph it.
You need the actual one, if it cant be obtained they will either pass it on to another DCa (rinse repeat) or the council.

Tell the council you are willing to pay their demand for money upon proof of authority.Tell them that the courts know nothing of any hearing or liability order in your name and they say that the council deal with it so send a true copy or desist.
This is as far as it will go, the council will en devour to keep you in the infinite circle but as long as you make an offer they can not escalate it to refusal to pay and threat of custody if they do threaten it remind them that you have offered to pay and there is no evidence of a refusal.You can refuse the interview with those grounds, they cant do anything but try and make you squirm!  
If they repeat then so do you, for the next infinite period or you do now have grounds to sue for harassment, which hasnt been done yet as far as i know with the council though there has been one vs the DC though, with success.
At the very least this will minimise their efforts and the statute of limitations is engaged.

Thanks, after a bit of a heated phone call this morning with the council, of course there untrained staff where annoyed that I wasnt taking what they said at face value. There only line of defense was trying to claim that I didnt tell them I had moved.

Anyways I have a solicitor helping me with it, so for now I have set up a standing order for £1 a month to fulfill my obligations. I`m currently moving off grid so not earning much. I`m tempted to potentially sue for harassment at some point, any of you think that this will work. Kind regards.

Hi everyone I just had word form jacobs that they attended my parents property to collect on the debt. The council are claiming otherwise, apparently there also saying jacobs tracked me to my parents address, I was wondering if I have a case against them to take them to court since they are now admitting I never owed £1790, but in fact £393.37.

Look at the Fraud Act 2006 and it fraud by false representation and a clearly defined offence.
Followed by the Theft Act 1968 where if they ty to deprive you of it permanently or temporarily it is a criminal offence.
