What would be best course of action for notice of enforcement?

Anyone know if councils actually instruct enforcement agents to break in and seize goods?

if anyone is interested i will update this thread to see how this plays out, ive decided to hold my ground given that enforcement agents cannot visit for non payment of council tax without a valid court order

Happy to see that you are making a stand.

I dont know your personal circumstances but if you are classified as a vulnerable person, bailiffs have to tread very carefully.

A vulnerable person can be defined as:
anyone who has an illness that has lasted longer than 12 months is considered Disabled under Section 6 of the Equalities Act 2010 Section 6.
anyone who is unemployed.
single parents.

I guess the list is endless depending on your own circumstances.

You could send a notice direct to the bailiffs and one to the council asking them to get the alleged liabillity returned to them.

Pretty sure they're not allowed to force entry for Council Tax arrears, unless they've already been let in previously and have taken control of goods.

No bailiff or enforcement agent can force entrance to a domestic property, I believe they can 'potentially' gain access through an open window, (don't leave any windows/doors open), however if you tell them to leave they have to do so. Income tax arrears or an arrest warrant are the only times 'technically' agents can force entry, but re income tax arrears it would have to be an extreme case to go to those lengths. However all the paperwork regards council tax is fraudulent in any case, including the document from the court. As said by flyingfish, if they have visited before and you let them in then again 'technically' they can request access again (a bit like vampires), however, if you refuse to give them access, yet again they cannot force their way in, irrespective of any previous visits where you did let them in. You have to stay strong in the face of these parasites, there are many things you can do to stop them in their tracks, but they try to instill fear firstly in order to make their fraud easier to carry out.

Best not to open the door,talk through it. or just ignore them . 'Foot in the door' is unlawful but remember you are dealing with scum.
Always record as a matter of course.

record any interactions , ask to see the liability order that gives the DC authority , make sure you record it. This leaves them open to prosecution for harassment if they continue to act without showing it after being asked. That case last December was won because the dc can not show authority because the physical liability order does not exist.
