Hi

Wondering if there is any advice in terms of suing the council, Leeds city council tried chasing me up at my parents address for almost £1800, basically I 'owed' just under £400 in actuality. They are ignoring basically everything I`m saying in terms of alarm harassment and distress and false representation, Im basically saying to them due to low income and there attempts to charge me for someone elses council tax I don`t want to pay the full amount.

They have ignored a subject of access request, sating its not with jacobs no more so its not necessary. They are trying to get me to agree to £20 a month I rejected it on the terms of I`m unwaged, I was paying £1 I said I would got to £5, I`m moving off grid to wales so once I`m there providing Iv signed nothing I may not continue paying. But just wondering if anyone with more experience than me with suing these organisations think I can put in a decent case against them.

Don't know how you worded your DSAR if it was for all information held by them or specific info.
In any event i would write back ;

1. Following your recent communication dated xxxxxx, your refusal to comply with my Data Subject Access Request has now been entered into my records as a refusal
to comply with the Data Protection Act 2018.

2. I require you supply to me your full evidence that i am liable for the sums you are claiming.

3. Please confirm if you are acting as a public servant. If yes please confirm that you are acting in a position of trust and therefor a trustee.

4. Please confirm that you are acting under your full personal liability and take full responsability for your correspondence containing your signature.

5. Under the Freedom of Information Act 2000 please accept this letter as a request under said Act : As your council carries the ability to use discretion regarding
discounts of Council Tax payments ,please supply (a) the number of discounts given for the previous 5 years,(b)the percentages given for said discounts .

6. Please confirm you personally are aware of and comprehend the Protection from Harassment Act 1997.

Something along those lines (always ask questions never make claims) . Always by Royal Mail & most importantly always to the one who has written to you and signed their name.
You will no doubt receive a reply from someone else ,dont be deflected continue to address everything to the original claimant from the council. Personal responseability is their achilles heal.

ask if the other person is legally representing the named person in this matter.
Or just interloping in matters not addressed to them.If you need their signature too or they should mind their own business .
