Hi All

After battling with the above for a couple of years for an alleged debt of £11,454 I enlisted the services of Howlett Clark Solicitors and for a small fee, they settled this by way of obtaining a Consent Order to withdraw the claim - which HOIST readily agreed to do! This was a post-2007 CCA that I took out in 2011 so I was more than pleased with the result.

Basically, they did not provide any information to support their claim against me and were in breach of all the CPR rules - even my solicitor said that they were more or less incompetent in the way they had handled the claim and not responded to the number of times and types of communication that I had sent to them and the Nottingham business centre.

I believe unless you are very experienced in this area it is better left with those that know the little 'tricks of the trade' and although it cost me £650 and some work on my part, it was well worth it in the end. I say this with having experience in this area and losing one case with RBS with whom I have a Tomlin order in place that I can't really afford but hey ho! That's life I guess.

Well done on your success jaysinc111, this is a huge encouragement to all of us.  

Can I ask what a CCA means please.

It would be very useful to know what rules they breached.  I am going through a similar process and as many details as possible would be extremely useful and helpful.

I totally agree Jinxer, I would be completely lost without this incredible advice, especially from Tiggy. Hopefully one day I will find a way to help pay back all these wonderful people.
