I received a letter from HPH Ltd. Please see below.
Should I start the 3 letter process for an acting agent? Thank you.

Re: Hoist Portfolio Holding Limited
I got the same letter over a year ago only hph2 and Robinson Way. I would send the letters, but don't expect to get a response to them other than it isn't a valid dispute. However, I sent the old letters, maybe the new ones will work better. I am still playing letter ping pong with them.

Re: Hoist Portfolio Holding Limited
Think I only got one letter after the notice of assignment, telling me I had 14 days to respond and come to some arrangement. It had already been sold to MKDLP previously.
They then passed it on to Howard Cohens ( solicitors ).
They never once sent any documentation I requested. CCA agreement request, pre-action protocol request was both ignored, then a claim was raised against me. Then a CPR 18 was sent, again this was ignored. After submitting my defence, both parties had 14 days to provide each other and the court every piece of documentation they wished to rely on, otherwise, it would be inadmissible. Still nothing from them. A few days after the 14-day deadline had passed, I received a letter of discontinuance from them.

warwick65 wrote:Maybe you could write back to them and enclose a copy of the notice of discontinuance from MKDP.
I am not legally trained but I do know if a claim has been discontinued once a defence has been entered , the claimant would need the courts permission to bring a claim again on similar grounds. As Hoist bought MKDP , I would think maybe they are the same claimant.
If MKDP were unable to comply with a CCA request then Hoist should struggle as well.
Even if they bought MKDP portfolio, I'm not sure they would legally be classed as the same claimant as MKDP. As far as I know MKDP has been dissolved so they're not a renamed Company (under the Companies Act a renamed Company is the same legal entity).
But I would definitely redo the CCA request with Hoist, as Warwick says if MKDP couldn't produce it why would they.
How long ago (approximately) was the default notice issued by the original creditor, have you ever requested a copy?

Chatty arn't they . Also making it very clear that they are not taking liability after making the statement that you owe a debt.

Re: Hoist Portfolio Holding Limited
Hello,
It’s been a while... I have received a letter from them saying, please see documents attached as requested.
There is one sheet of document - application retrieval in table form.
I don’t remember requesting it. Should I reply to them? If yes, what should I say?
Thanks.

Re: Hoist Portfolio Holding Limited
I would reply along the lines of.
I am in receipt of your letter dated xx xx xxxx .Despite my numerous requests for specific documentation in regard to this alleged debt ,you have once again failed to supply these.
The documentation I requested should be readily available if you believe you have a valid claim .Therefor I am somewhat
surprised that you will not or cannot provide it .Given that I have stated I will meet any lawful obligation upon production of verifiable documentation.

Re: Hoist Portfolio Holding Limited
I would carry on with these ,https://goodf.forumotion.com/t1163-new-alternative-letters-for-dca-s-acting-as-agents
I know its a lot of typing but it will show yet another request from you that you have attempted to settle and once again they have failed to comply with your requests.

Re: Hoist Portfolio Holding Limited
Hello,
I have started three letter process again, and have received a response to my first letter. The response is basically the same as they sent me before. They seem to ignore the request of providing requested documents in the letter.
Should I continue with the second letter and third?
Thanks.

Just carry on with the letters, & count that as another refusal to supply documentation.
