Restrictive Covenant Question Empty Restrictive Covenant Question

Post by Phillpots Wed Nov 01, 2017 10:18 pm

A large government building still in use (more like big blocks that look very 1940's) in my area and is very much surrounded by houses. I checked on the title and plan (for the price of a couple of pints why not) and this register plan has 4 names who have restrictive covenant charges on the title.

Anyone have any thoughts on this? Based on my previous question there are no water or electricity companies on the charges with this one nor any mayors.

Interesting to note that the 4 people are either sir or OBE decorated and all are now dead from around the 50's and 60's. The register entry on the title is from 2009.

Types of Restrictive Covenants

Three basic types of restrictive covenants exist.

A non-compete agreement restricts the activities of one party who agrees not to compete with another, often his employer, for a specific period of time and within a specific geographical area.
A non-solicitation agreement restricts marketing and hiring activities by one individual in a business agreement. One party agrees not to solicit employees or customers from the other.

A non-disclosure agreement restricts communications. One party agrees not to disclose business secrets, trade secrets, proprietary processes or other specific activities or information related to the business.

What restrictions do they apply? Could be almost anything, for example near to us a school was originally donated, and a restriction on the title said that if it was no longer needed as a school it had to revert to the original landowner (effectively a prohibition on selling it on if no longer needed).

Hi assissin thanks for the info.

pieintheskywhenIdie I would really like to know where you got info like that as the titles and plans I purchase do not reveal information like you have stated.
