Claimant Replies after long time
Hi Everyone
Firstly I am so glad to have found this forum, I was sending messages in the old GOODF and wondered what was happening then clocked on that the GOODF were not giving any replies after around May 2017.
Previously I was receiving great advise from Tiggy in the GOODF which was really wonderful of her, I have seen a Tiggy here within this forum and if this is the same person please do respond
Now for my case, I had a credit card debt being chased and it went to the court.
I applied the three step process with my defence online to the court, sent the CPR 31.14 and the CCA letter.
They totally failed to respond within any time frame required, and I was hoping that would be the last of them! But after some good time I just received a letter from them requesting that I make a payment plan!
They sent me a copy of the CC contract, letters of assignment, CC statement.
Any advice how/what/when I should reply?

I am the same person, but haven't been able to log if for a few days. So basically, now they have everything they need for the claim to proceed.
What you have to do is go though everything they've sent, especially, the agreement to see if it's contains all the prescribed terms.

I'm so happy to have found you again and that you've resolved any issue you had been having in logging back in here
Can you please advise on what 'contains all the prescribed terms' is, and what exactly should I be looking for.
I feel lost, and there is quite is bit of paperwork.

Presumably this claim is now stayed at Court, basically, all they have to do is put in an application to lift the stay and proceed with the claim.
The prescribed terms are set out in Section 62 (I think) of the CCA.

Do this imply, that I should not respond to their letter and just allow them to continue the process of trying to lift their claim ?

Unless someone can actually advise on the process at the stage of my defense and what I should do to counter the lifting of the claim I don't think me or anyone can defend
