you could send the estoppel if you wish but like daveiron says they will simply ignore it.

So their most recent letters, are they just rebutting your letters or are they threatening anything further ? it depends really on what they are actually saying to you.

you need to be looking at that SAR too, check the 'agreements' sent by intrum and the OC and check for a default notice.

Threatened bankruptcy proceedings  - Page 3 Empty Pre -action protocol letter

Hello everyone hope you had a great Christmas and a good new year,Its been all quiet on the Intrum front but I was expecting something in the new year and January the 8th it came, a pre-protocol letter from Moon Beever solicitors along with a Reply form for me to fill in.
I have attached the letter, I need advice on this, can any one advise me what to send off with the reply form and can I defend myself against this .
I have had a look for a default notice as suggested but cant see one is it a obvious letter ?
To me this is serious and scary thanks for any help or Advice given Andy

yes that is an official letter before action

you need to respond to it within 30 days and request any documents that you are entitled to otherwise they will take it straight to court without sending further correspondence

Thanks Waylander62 I thought it was the real thing but thought it was best to have it confirmed.
I have had a look on the forum and its a bit confusing but from what I can gather that the reply forms are a fairly new thing and I dont have to ask for the deed of assignment as I can ask for documentation on the form.
I dont know if you have seen one of these forms(when I get home I will post them on here it may be of help for some people)
I presume that I tick the box "I dispute the Debt"
Box H says " I have provided documents for" do I send copies of paperwork I sent to the D C A.s
Box I says "I need more documents or information" I presume this is the bit I ask for the deed of assignment and seeing as I cant find a default notice should I be asking for that .
what do you think will happen next ? many thanks as always I would be at a total loss without you Andy  Smile

in my opinion what you should do is:

dispute the debt, fill in the form which states that you require documentation and simply put in the box ( please see separate letter)

write a letter requesting the documentation that you are entitled to including the deed of assignment, and also send an official CCA request.

Thanks waylander62 I will do that tomorrow god willing, I've found a cca request template on the national debt line website and will get a postal order tomorrow.
other than the deed of assignment and a copy of the default notice is there anything else I should be asking for ? as always thanks for your help Andy

yes you want statements to show how any sums claimed have become due

and you want a copy of the termination notice

do you have any old statements that you can refer to ?

did you have any form of PPI or insurance with the credit card ?

Hi waylander62 thanks for the information ,my apologies for not responding sooner but I didn't get home until last night.
In response to your questions I didn't have PPI and I don't have any statements but what I do have is a pile of paperwork that the Halifax sent me when I sent the SAR request.
I am home until Monday and will get this ready for posting today and post it early next week .once again thanks for your help and patience Andy

there should be a load of statements in the SAR , check them out for charges etc

Hi waylander62 just got home to find a envelope from Intrum I've had a look and they say they have met the requirements of the cca
I will try and post the letters but the website rejects them I will have another go when I get the chance.
in a nutshell they have sent me :- statements,notice of assignment, a copy of the original agreement but they say the deed of assignment is a legally privileged document and they are not obliged to supply it, and they say that the OC has told them that they do not have the default notice because they sent it to me and that that they have sent a screen shot of when the OC sent the default notice ,but I cant find this .

dont have a copy of the default notice because they sent the only copy to you !! never heard owt like it !!

check the SAR from the OC for
a) a copy of the agreement
b) a default notice

Hi waylander62 I can't find the default notice but I have a number of copies of the agreement sent by different DC s over the years that is signed by me but not them.
I have found the screenshot that says the default notice was issued on the 14th January 2014 .
I have tried to upload the letters but the website says" exceeded user amount storage " .
I have tried to delete some old posts but I can't do that ether thanks for your time and patience I am away until Wednesday probably but look fo ward to your response thanks Andy

Hi LynnB ,I am no expert in this just someone like you that fell foul to these parasites but you have come to the right place for help,support and advice.
Please remember that to them its business, its not personal, they just want money and they will lie, bully, threaten and scare you to get it .
This post is my story of my battle with Intrum until this point .
