THreatened with court actiuon from solicitor

Hi everybody - im being threatened with court proceedings by kearns solicitors on behalf of a debt collector over a £1900 credit card ‘debt from barclays that I stopped paying in 2013 when I discovered the scam thanks to the GOODF website (the debt originates from 2011 and I was paying it up until then)

when I receieved their first letter a few weeks ago I went on the defensive asking them for a copy of my signed contract with the debt collector(asset link capital) etc – but they've come back at me straight away threatening court action and sending me a copy of my original credit agreement with barclays signed by me (only by me, not them), along with a letter from barclays in 2016 saying that they have closed and transferred the account to asset link capital (which means they have bought the debt right?) and I presume which also means that kearns are now threatening court action on behalf of the debt collector and not barclays?

My problem is I have no paper work of any template letters from the 3 letter system I originally sent to barclays – im pretty sure I did send them but where they are now, I do not know (idiot, I know, I know) Thus I cannot use those letters as any kind of defence. What do you recommend I do in this situation? At the end of the day as far as I can see I have no contract with asset link capital but the tone of these solicitors letters has unsettled me somewhat (‘should you fail to negotiate settlement a summons will be issued against you’ etc)

I went on the GOODF website the other day and sent off what I could find in defence, Firstly a 'Pre Action Conduct - Request for Information' letter to the solicitor, and secondly a s.78 of the Consumer Credit Act 1974 letter (with £1 postal order) to the DC

Ok - just wondering if anyone can give me a bit of advice now - knowing these people they will probably ignore what I have written so what do you reckon will happen now?

By the way - ive been away for a couple of years and didn't realize that the GOODF website had been compromised - only just found this new site today (sunday 22nd april) otherwise would have wrote earlier before I replied to the solicitor and DC. I'm so glad to see there is a new community website!

Any advice from anyone out there would be much appreciated. Thank you in advance

hey dave thanks for the quick reply. I wish I had found the new site sooner but ive already sent the 2 letters I got off the GOODF site. I suppose I will just wait and see what happens now as regards their reply. Will post again on here once received and hopefully you'll be about then to point me in the next direction. If they have actually issued a claim you need to treat it accordingly rather than using the three letter process

You need to make sure you get of a S78 request as well as a CPR 31.14 request

Make sure you acknowledge the claim online as well with your intention to defend all

If no claim has been issued then be prepared for one and make sure you know how to respond
