Good afternoon members Very Happy

Bit of a trivial post this but might provoke some debate - who knows?


My nephew receives free school transport (age 13)

Yesterday someone at school either for a joke or whatever took his school bus pass from his pocket without his knowledge and failed to return it - kids eh......

He can get a temp pass from school but it only last for a maximun of 3 days, then his mother will have to get a new pass from the council. I contacted the council today on her behalf and they said there is a charge applicable of £5 for a replacement pass ................. when I questioned this I was informed it was council POLICY!

Now we are aware it is a small amount to pay ;however, its the principal of the matter we are unhappy with.

The council are oblidged to supply free school transport but how can they get away with charging for a replacement pass - the origonal pass had NO charge to it.

Yes this is very trivial but its just another way the councils seem to be applying their policies of taking more money from we the CT payers.

I suppose you could try the angle of asking if they are aware of their obligations under the United Nations & E.U.
conventions on Human Rights and are they willing to breach these by denial of the free transport to which the child is entitled to.


Universal Declaration of Human Rights
Article 26.


(1) Everyone has the right to education. Education shall be free, at least in the elementary and fundamental stages. Elementary education shall be compulsory. Technical and professional education shall be made generally available and higher education shall be equally accessible to all on the basis of merit.
(2) Education shall be directed to the full development of the human personality and to the strengthening of respect for human rights and fundamental freedoms. It shall promote understanding, tolerance and friendship among all nations, racial or religious groups, and shall further the activities of the United Nations for the maintenance of peace.
(3) Parents have a prior right to choose the kind of education that shall be given to their children.

You could also report it to the po-lice as a theft, they will not act but they will give you a crime number which shows its been reported as a theft, and the council can then look into the matter and bring a private prosecution against the individual who stole it; but they wont.

We have a positive result cheers the council have agreed to apply "their disgration" and issue a new pass free of charge. I did speak to someone and put across some of the info above which he dismissed "of course" but atleast the issue is now ressolved.

Just need to photo copy 20 passes in case it happens again!! ..... I am aloud to copy them - arnt I? lol! lol!

Interesting, there are schools that have no supplied buses...there is a reduction to the cost on public transport, but the parent/s have to pay for the bus/journey to school.
After (1) above, is it legal for councils to make parents pay?

I believe its based on the distance you live from the school ,from memory it used to be 3 miles.
Back in the day it was not unusual for kids to walk a couple of miles to school, Unlike today
where if they live more than a hundred yards away they need to get there by a 4x4.

hi daveiron, yeah seems to be the case, as many of us have spent a fortune on bus fairs over the years that if we shouldn't have paid, should they be paid back.

Free school transport https://www.gov.uk/free-school-transport
Your children may be able to get free transport to school, depending on how far the walk is and any special needs they have.
All children between 5 and 16 qualify for free school transport if they go to their nearest suitable school and live at least:
2 miles from the school if they’re under 8
3 miles from the school if they’re 8 or older
Find details on free school transport from your local council.
If there’s no safe walking route, they must be given free transport, however far from school they live. Contact your local council if you think that the walk to school isn’t safe.


Fair enough but
(3) Parents have a prior right to choose the kind of education that shall be given to their children.

What is "a prior right" in this instance?

I would imagine ,without looking into it that if for instance you decided to send your little sprout to
a catholic school over 3 miles away ,and there was a state school within the 3 miles ,you would not
qualify for the free bus.
That i would imagine would be their excuse .
