I have now had contact from intrum they have sent me copies of old credit card statementsand a short breakdown of payments but they haven't provided a copy of the signed credit card agreement where do i stand should I write back and say they haven't provided the correct document ie the signed credit card agreement.

Good morning! Are you able to confirm if they bought the debt (a Debt Purchaser) or if they are simply agents collecting on behalf of a Debt Purchaser (DCA)? Have you sent any template letters yet?

I think they have bought the debt from Tescos because i had a letter from tescos telling me that the money was now owed to intrum.

The letter said we have decided to transfer (sometimes this is called assigning) all of our rights in connection with the account from our internal collections & recoveries dept, to another company.

This means Intrum Uk finance ltd will take over all our rights in connection to your account. Then just said I should pay intrum and not them.

I did send of the first letter and intrum refused to acknowledge the letter and said they get these all the time from people who haven't sort the correct debt advice

Hi ,

Yes Intrum are purchasers. If that letter you sent was for debt purchasers continue with letter 2
if not start with letter 1. Whether they like it or not ,you require a proper response from them.

Have just checked the paperwork again and there is a signed copy of the credit card agreement taken out with Tesco financial services so it looks like intrum have just bought the debts in bulk from Tesco. Where do I stand I know I owed the money to Tescos but now it's been sold what rights do I have. Why are financial services allowed to sell your debts for peanuts and then expect you to pay back the full amount when the debt has probably been bought for 10p in the pound. This causes so much stress for everyone why not allow the debtor to buy the debt at a much reduced cost. Do i have any right to know how much the debt was bought for

Sorry for ranting but I am so fed up with how we are treated by the banks.

Just follow the letter system and don’t admit to owing anyone any money within the confines of this forum (where DCAs / solicitors etc have been known to troll) let alone outside... ;-)

is this a fairly recent credit card ?

check the statements carefully for any PPI or insurance payments, how far back do the statements go ?

is it an agreement they have sent you or copy of an application form.

it would also be a good idea to send off a SAR to tesco.

the from is dated 2000 so it goes back a few years i had been paying
Tescos £1.00 per monthly until it was sold to intrum on looking at it closely it looks like it's a copy of the the card application and not an agreement. Where can i find a copy of a SAR and what is it?

a SAR is a subject access request for all information they hold about you

all statements, any agreements, default notices and anything to do with that particular credit card.

have received the following response from intrum after my second letter
Please note we responded to your previous letter with the same content of 15 feb 2019 on the 21st which included Notice of Assignment and we sent your signed agreement (this was a signed copy of my credit card application and not a signed credit card agreement)and statement to you on the 25th April. Please note we are still awaiting further payment history from the original creditor and this will be forwarded to you as soon as it is received.
Regarding your request for a true copy of the default notice, the original creditor has informed us that this is not available however they have confirmed the notice was sent to you on 12 Jan 2009.Please note that banks are not obligated to keep documents indefinitely and it is standard practice is our industry to retain document for 6 years.
We hope this helps and ewe will be in touch once we receive the documentation from the original creditor. Should we receive correspondence again sourced from "debt free"web record will be kept on file and you will not receive a response.
My question is do i still send letter 3 and the estopple do I point out that they have not provided the credit agreement signed by both parties.
I still haven't had anything back from Tesco's after send them the SAR
Any advice would be very much appreciated.

Yes carry on with the letters. Are they saying a default notice was sent in 2009 ?
What if anything has happened since 2009 ?

The SAR should be sent to you no later than a month.

Edit ,just seen previous posts .When did you stop paying anyone ?

back in 2008 when i fell into financial difficulty i panicked and agreed to 1.00 per month payment once the debts were sold i also have a couple with cabot
i stupidly agreed to make the same payment to them as i didn't know about this site until later. Don't want to make the same mistake again

Chase them and remind them of their legal obligation to respond within one month with all of your personal data.

Did you send via signed for delivery? If so, also tell them of the date your first letter was signed for.

Still nothing from Tescos regarding the sar but today i received from intrum some credit card statements showing the monthly £1.00 payment upto when tescos sold the debt not sure how to proceed haven't received the signed CCa by both parties where do i go from here

Time to complain to the ICO regarding the SAR .Its info you require and are entitled to. sorry cant leave a link as their site is down temporarily this morning.

Normal collection activity at this stage will probably be more begging letters. No problem.
