it depends upon who you sent the SAR to ?

the SAR should have been sent to tesco directly it sounds to me you have sent it to intrum ?

no paperwork would have been sent to intrum by teso when the debt was sold it never is, so no tesco's would not have provided everything they may have

does it mention the application in their most recent letter ?

Did you send the SAR to Tesco or Intrum ?. If you sent it to Tesco and they
passed all your banking info to Intrum,I would imagine they are in big doo doo.

Hi

I sent the Sar to Tesco's requesting the information twice, had no response so filled out the complaint form to the ICO including copies of the letters that I sent to Tesco's and this is what I have had back but it has definitely come back from Intrum not had any response at all from Tesco

have intrum sent a covering letter with the docs they have sent you ? telling you what it is they have sent you and why they have sent it ?

i can only assume that tesco have failed to comply with your SAR request and Intrum have sent you documents to fulfill your CCA request ?

unsure as to what is going on.

Intrum have sent a covering letter with the documents but they are just copies of all the documents that they have sent previously plus about three pages of emails trails .

Plus a really long letter with lots of different paragraphs
Why do we have access to and process your personal data.
What Categories of personal data are you processing about me and why
Are you processing any sensitive data
etc it goes on for about four pages

They have also included copies of the letters I sent to tesco's requesting the information so i think because i complained to the ICO Tesco's have got intrum to reply not sure where I go from here but for now the account is still on hold

go back to the ICO and complain further about Tesco not complying with your SAR and getting Intrum to respond on their behalf

have intrum sent you anything that has NOTHING to do with the actual account they bought. If so then Tesco may have screwed up big time.

in respect of Intrum, if the account is still on hold, then i would leave it there.

Hi

I have now had further contact from Intrum just sent the same information again Notice of assignment and a signed copy of my credit card application that dates back to 2000 and an income and expenditure form to complete.
All these have now come fro the Legal Department

They have acknowledged that Tescos can not provide a copy of the default notice as banks or not obliged to retain documents for more than 6 years

My questions now are how do i respond to this letter, and if it was to go to court because they have some old statements and letters of assignment where would i stand.

The only thing i have is a copy of my credit card application at the top it says Apply for your Tesco Visa card today. I don't have anything else other than a few bank statements

And can i ask what is the difference of a notice of assignment and a deed of assignment

The deed is the actual document that assigns the debt ,(you will never be
provided with that) The notice is just a doc that informs you that it has been
assigned.

You may want to consider asking these further questions from them;
1.Do you have the original agreement ?
2. Do you know where the original agreement is ?
3.Will you be able to produce the original agreement in court ?
4 Can you provide first hand evidence that the copy you may have is the
only copy in existance ?

The truth is they will not have the original ,it could be anywhere in the world
and could have been sold many times over. If they were paid by you on the
evidence of a copy only,what is to stop another parasite in the future comeing
foreward with another copy ?

I would suggest waiting for Mr Blue & Waylander. I have to take my PC in for
repair today & may or may not be able to reply for a week.

how threatening is this letter ?

they dont really have much of a case, the 'agreement' is not compliant with the CCA and no default notice is a real problem despite the 6 years bullsh*t

does their legal department have an SRA number at the bottom ? ( small print )

have Tesco responded to your SAR request and i mean TESCO not intrum

The letter isn't at all threatening they are requesting that I complete the financial statement and return with an offer of payment.

Can't see an SRA no.

Tescos never responded to my SAR request but I was contacted by the ICO
and mentioned that I had received the SAR from Intrum and not TESCOs she said it was usual practice when a debt is sold you deal with the debt collector and not the original OC. It looks like Tesco's have washed their hands of the whole thing.

Intrum just keep sending the same documents every time I request anything notice of assignment signed copy of my credit card application old statements.

in the first instance what i would do is write a short simple reply to the legal team, acknowledge their letter, then respectfully ask them to provide you with their current SRA number. thats it leave it there, lets see what they respond with on that one.

I will come back to you on the ICO.

who are the company that this has been assigned to ? full name please.

Just looked at when this thread started ,its now 15 months ,and they still have
not made good on their threats. That alone tells you they cannot obtain what
they need from Tesco's to proceed .It seems clear Tesco's do not have it.
Have you received at any time the terms and conditions for this agreement ?

They must provide you with a true copy of the original terms and conditions
to have any sort of claim .
As this is pre 2007 they cannot give you a reconstituted copy.
Clearly Tesco no longer have it ,& Intrum certainly dont.
Dont rush to reply to anything ,next time you reply tell them you require
a certified copy of the T&C and if they cannot supply them to leave you alone.

Hi

It's been some months since i have heard from Intrum and today I have received another letter requesting payment. it states Should I make no contact they will pass the account to their solicitors with the intention of issuing me with a letter before claim in accordance with the formal legal process (Civil procedure - Pre action protocol). Should I be worried or is this another threat

difficult to predict what they will do,

i believe it has been with their legal team previously ? and here we still are !

have tesco complied with your SAR yet ?

what i would probably do.....

acknowledge their letter, then simply write something short and simple. : It appears that you, Intrum etc, are simply not responding to my request for compliant documents to be provided so that i may lawfully ascertain my pos. in this matter.

To this end and for the avoidance of doubt i will await a letter before claim from your ' unregulated' legal department and respond accordingly via the necessary forms and following the correct protocol and procedure. Allowing the Courts to be made aware at an early stage.

I await receiving your letter before claim
