although it may prompt a lot of disagreement a solicitor is a must if you want to make a serious appeal.

the importance is how long you have to appeal, is it x days after judgment or x days after receiving the official judgment from the courts ? a big difference here.

'a solicitor is a must if you want to make a serious appeal', yes, I have been mulling over that one waylander. I certainly can't afford one at the moment but maybe in the next six years I'll have enough money to buy myself some legal eagle help and stir things up with a counter claim. Unfortunately the pursuit of justice always costs money.

Cheers Mrblue, I'm not for giving up, I've just fallen down into the ditch temporarily and have to climb back out.

Sometimes it does get to me a bit but I guess that's the same for anyone when things don't go the way you would like but it doesn't last long and I'm on to the next round of the fight. Very Happy

it costs nothing to have an initial consultation with a solicitor, you can explain what happened and they can then decide if you have a case and will tell you how much this is likely to cost

but time is of the essence.

If you have a GENUINE CASE you can get insurance backed legal assistance and this works as follows:

You appoint a solicitor and they assess your circumstances, and if you fall below the threshold you become eligible for this insurance.

With this insurance you are offsetting all liabilities and costs if you lose, basically you lose and the insurers pay, but you have to pay the premium upfront.

Your case will be assessed for viability and it will be put before a barrister who will give an opinion of the viability of the case winning, and in many cases it has to be above 50%, with other insurers it may be above 60%, if this test is passed then you pay the premium if you choose to proceed.

However; if you wil there will be a deduction of around 25% from your award which goes to your legal team as bonuses and if you are awarded £10,000 as an example, your premium and 25% will be deducted.

To this day I still (unfortunately) get a little wound up when I receive letters. As in I can’t believe how low these ‘people’ are / how they can make a living in this way. 

BUT the fear has long since gone which I had (and most of us did) when we very first started. Like I said in another post, it’s a game and you realise they are and they have NOTHING. ;-)

Oh and here’s a tip: another example of how low these ‘people’ are is they always tend to ensure you receive their letters on a Friday ie in an attempt to spoil your weekend. Well that’s fine as I have now long since learned not to open any unrecognised envelopes received on a Friday until Monday and put the envelopes out of sight until Monday ;-)

Thanks waylander, I have tried to find a local solicitor over the years but to no avail so far, a couple of years ago I had a free 30 min 'phone consultation with a well known (but can't remember his name) solicitor in Brighton about my Cabot case and he didn't have a good word to say about them. Since then he hasn't responded to my inquiries ..... probably because I've had my 30 mins worth and there are hoards of other people like me baying for his attention.

Thanks assassin, I've not heard of insurance backed legal assistance before, I'll have to see what I can find out about it.

Thanks Mrblue, Cabot and Lowell sent me pre-legal assessment letters which arrived a couple of days before Christmas which demonstrated to me what type of slime bags run these corporations.

I have a feeling that these DCA's don't post the letters on the day they are dated as they always seem to turn up a week and a half after the date with a two week time limit to respond leaving only a couple of days to actually respond. Very sneaky.

Indeed they are slime bags and are pathetic. A good example of pathetic is lowell telling the court in their witness statement that I had 'forced' them to make a claim against me, yeah, of course I did, I must have had their arms firmly twisted behind their backs to 'force' them to do anything.
