Cabot Bought Old 'Debt'
Hi All
Some of you may remember my thread on the original forum regarding two RBS credit cards I was being chased for. There is a thread on the 'Success Stories' part of this forum detailing how I finally got rid of the larger of the two (just under £11,000) back in 2017. The smaller of the two (just under £5000) I hadn't heard anything about since October 2016. Until Saturday, when I get a letter (or 'welcome pack' as Cabot rather cheekily called it) from RBS/Cabot advising me that Cabot had now bought the alleged debt.
Letter one was put in the post within an hour of the postman coming.
On Monday I got an email saying 'Welcome To Cabot'. The way they try to present themselves as our friends is staggering. Anyway, the reply was as follows:
"Please unsubscribe this email address from your mailing list. You DO NOT have my permission to use it.
I will ONLY deal with you by letter. Any form of contact including, but not limited to, written, email, mobile telephone of landline telephone number will be regarded as harassment and unlawful use of my personal data under the Data Protection Act 2018 and GDPR laws. this will result in legal action being taken against you under the Protection From Harassment Act 1997 and the aforementioned data protection laws
I do not acknowledge any lawful debt with yourselves, and have not entered into any contract with Cabot Financial (Europe) Ltd or any associated company, and will not, under any circumstances, be doing so.
I trust that makes my position entirely clear."

Update on this one, Cabot have been chasing me since the end of June. They tried to make out I owed them, but I just kept writing back pointing out (in no uncertain terms) there was no contract between them and me, and the things they sent didn't constitute a contract. I put a few personal barbs in there like:
"This is at least the third time I have explained this to Cabot. It must, surely, have registered by now that I DO NOT lawfully owe Cabot anything and that Cabot have absolutely no valid or lawful claim against me? I must again say that ALL and ANY further attempts to collect this unlawful, unvalidated, alleged debt will prove futile, pointless, and a waste of your time. If it doesn’t, I will keep telling you, in writing, until it sinks in. If you are happy to carry on wasting your time and money, I am happy to help you in doing so. At least then you will be spending less time harassing other people who, like me, don’t lawfully owe you anything. I must say, though, I do admire Cabot’s persistence, or maybe it’s just blind and wilful stupidity and/or delusion on Cabot’s part? I suppose harassing people for unlawful debts and attempting to frighten them must be very lucrative when they pay you money they don’t lawfully owe? Though, I do wonder how you and your colleagues manage to sleep at night. Do your consciences not ever trouble any of you at all?"
and
"Can I ask you – is this what you wanted to do when you were a child?
Did you answer you careers teacher at school, when they asked what you wanted to do when you started working “I would love to harass innocent people for money they don’t lawfully owe”. I bet you didn’t. Are you proud of yourself now?"
And this alleged debt is now stature barred, so there isn't anything else they can do now anyway. This is the last outstanding issue I had.
So, thanks to everyone who helped me on here and the old forum.

Just a postscript to this. Today I had a letter from Cabot saying this:
"Thank you for your letter dated 23 October 2020, I apologise for the delay in responding to you.
Thank you for clarifying you do not wish to have an open complaint with us, I have closed the complaint and no further response will be issued.
We maintain the position set out in the FRL but agree that the account is now statute barred under the Limitation Act. For this reason, I have closed the account and we will make no further attempts to contact you.
I hope this matter has been concluded to your satisfaction."
They finally have given up.

They will sell it on and someone else will try, I suggest you include your list of charges and if anyone else tries collecting, you include this, if they try they have entered a contract on your terms and you bill them, if they fail to pay then its a valid contract to small claims court time.

No, it's now statute barred, so there's nothing anyone can do. That is the only reason Cabot accepted they wouldn't get anywhere.

It's not inconceivable that the mug that was Cabot may still sell on to an even BIGGER mug and therefore you might get approached again BUT going forward, it will be easy to fend them off with that simple one-liner

Debt companies specialise in buying statute barred debts as they are sold off in legitimate blocks of debts and these companies try every illegal tactic going and have no respect for the law, one such company tried it with be and hid bald headed, tattoo covered thug threatened me and threatened to spread me all over the ground, I pulled out a shotgun and said I would spread him evenly all over the ground, boy could he run.

Love it. I bet he thinks twice now.
I do have an advantage of being 6'4" and built like the proverbial 'brick toilet', so it's not easy to physically intimidate me. What I will say is that a Maglite 4D cell torch, when full of batteries, is very handy in the event of power cuts especially in winter. It absolutely and definitely must NOT be used to defend yourself, as it could really hurt if someone was hit with it. For example, if they were hit over the head it could cause them to be knocked out, concussed, or temporarily taken out of action, which would be terrible, and I couldn't possibly condone or encourage violence.

You can use reasonable force to defend yourself, but once they threaten to kill you its gloves off time and use any force necessary.
