HSBC - threat of legal action
Hi all,
In January this year, I followed the 3 letter process with HSBC. The alleged debt is just over £5k. Their Litigation Department wrote this week and are threatening legal action.
Why hasn't the 3 letter process worked?

Because HSBC are now using their in house Solicitors to chase debts, they don't appear to be selling them on, so they're very likely to have all the proof they need to get an order against you.
What's the original debt for ? Have they sent you a copy of your original agreement ?

should the agreement still be checked to see whether or not it was properly executed etc?

That and a copy of the statement account is usually all they need, unfortunately. Yes, you can go through it with a fine tooth comb to see whether it contains all the prescribed terms.
