Private Record Of The Parties Empty Private Record Of The Parties

Post by assassin Wed Dec 06, 2017 3:16 am

What is a private record of the parties? basically it is a documented record of an event or series of events, and it is clearly misunderstood by many people and this misunderstanding of what it is often plays into the hands of someone challenging you for anything such as money over an alleged debt. By creating a private record of the parties from the outset you can strengthen your position in any case, and often create sufficient dount in a DCA's mind to prevent them bringing a claim against you, or often stop them mid stream.

When do I start a private record of the parties? right from the outset, if you get a letter first then this is where you start, if you get several phonecalls then start with the first one, and if you have call block and find calls from an unknown or witheld number then this is where you start.

What do I record? everything, this is the reason we only deal in writing and to allow them to incriminate themselves and your average DCA knows this as anything written is there for all to see, on the other hand a verbal telephone conversation comes down to their word against yours and guess which side most courts will side with.

Any documentation you receive.
Any documentation you send.
Any telephone calls you receive, and note the time and date, and if you get a call list you can copy this and highlight it in highlighter pen to prove these incoming calls as your evidence.
If you receive a telephone call you never admit to anything, especially your name and address, and you inform them to deal with whomever they are trying to contact in writing, and record both the call and the fact you told them to contact whoever they were trying to contact in writing.
Any suspicious vehicle types and registration numbers loitering or parked up in your area or vicinity as often a DCA will sit and watch a suspected property, and if you call the police about a suspected vehicle this will be automatically recorded by audio and in writing on the call log which the police keep for at least one year. Phoning the police is often a good idea anyway for evidencial value alone.

How do I record all this information? you can use any form you like, courts rely on paperwork and ultimately everything comes down to paperwork but you can use any medium you like.

Paperwork, always keep anything you receive in logical order and take a copy of the document, most printers have a watermark function so print the word "certified copy" onto copies of documents, even if you have to print onto several sheets of paper with your watermark before copying a document onto that paper.
Audio, record these onto a CD or DVD and mark the CD or DVD with its contents and the date and time the recording was made, the length of the recording in time, and who made the recording and at what location.
Photographs and video, always take two pictures and print them out with their date and time printed onto them; you take a close up shot to collect details of someone's appearance and any vehicle registration numbers so they are clearly legible, then take a wider shot showing specific surrounding details such as buildings, monuments, or any other local detail so they cannot deny they were there, with video a quick pan round slowly can include a lot of details.
Audio visual, if you record something with both audio and video recording it is always better to speak and give a recorded account, state the location and pan round and record the location and the proximity to any features such as a shop you are outside and if someone is in a vehicle you can state the make, model, colour, and how many of them there were, and a brief description of their appearance.

IF YOU DOWNLOAD THIS TO A COMPUTER TO COPY ONTO A CD OR DVD YOU ALWAYS LEAVE THE ORIGINAL RECORDING ON THE DEVICE YOU RECORDED IT ON; THERE IS THEN NO DISPUTE AS TO ANYTHING BEING MODIFIED OR DOCTORED AND IT PROVES THE CD OR DVD COPY IS A TRUE COPY OF THE ORIGINAL AS BOTH CAN BE PLAYED IF ANY DISPUTES ARISE. REMEMBER THAT THE DEVICE ONTO WHICH YOU RECORDED IS THE ORIGINAL AND ANY CD OR DVD IS ONLY EVER A COPY; NEVER DELETE THE ORIGINAL.

Record everything in documentary form and if need be you buy a cheap ring folder and cheap punched pockets which are cheap transparent sheets which hold documents and fit into a ring binder, put one document into the punched pouch facing forwards and the next document into the same punched pouch facing the opposite way so when you place this into your ring binder folder you can see the pages as you turn the punched pouch and its contents in the order you received or sent them.
If you have audio or video then print a sheet stating what it contains, where it was taken, the time and date it was taken, and on what device it was taken, you can them put this sheet into a punched pouch along with any CD or DVD.

WHEN YOU SEND DOCUMENTATION YOU NEVER MAKE THE CLASSIC MISTAKE OF PRINTING TWO OR MORE COPIES OF A DOCUMENT OFF AND ONLY SIGNING ONE COPY AND SENDING IT; YOU NEED TRUE COPIES SO ONLY EVER PRINT OFF ONE COPY, SIGN IT, THEN COPY THE SIGNED DOCUMENT AS MANY TIMES AS YOU LIKE AS A COPY OF A SIGNED DOCUMENT AS COURTS OFTEN LOOK FOR SUCH TECHNICALITIES TO FIND FOR A DCA; AND ON MANY OCCASIONS THEY CLAIM YOUR RECORDS ARE NOT TRUE AND ACCURATE COPIES TO FIND THE DCA.

Logs such as telephone logs can be hand written onto a template document which you can produce on a computer as a master log, you can then individually print off a sheet and place this into your folder, remember to record all the details onto this individual document such as any telephone number, any names given, any company given, and obviously the date and time, by creating a master log of all the calls, and an individual sheet with all the details of the call on you have both records in your records.

Photographs, particularly those with injuries, all need a date and time and the breif details of what the photograph contains, if you record injuries to your right arm this needs stating as well as the date and time as people may know it is an injury to an arm but not know which arm it is, and always add the date as most physical injuries need photographing over several consecutive days. Always add this information to a sticker and stick it to the photograph in an obscure place, OR just use a small sticker and number it and print off a description of the injuries onto a seperate sheet with the photograph number and staple it to the photograph before putting it into your punched pouch.

Home visits always need recording, do another template and note the time and date of any visit, vehicle details such a van or car and its registration number, and always ask for identity and record who visited, and also if they refused to show you identity.

Many DCA's and others visiting you are sneaky so remember this, if they are wearing a recording device then note this as you can do a SAR and retreive this recording.

Keep copies of all your recordings and your private record of the parties and store different copies in different places, if you keep them all at home and you have a fire they can all be destroyed and you have no evidence of anything, you can have a flood and this can destroy a lot of your documentation, and in cases involving the police always keep at least two copies of original documents in more obscure locations as keeping a copy at your mothers or fathers may suddenly see you and them suddenly be raided on trumped up allegations, and believe me this does happen, and all your devices and paperwork will never see the light of day again.

Private Record Of The Parties Empty Re: Private Record Of The Parties

Good work assassin.

For many this will save them from an adverse court finding.

The more debtors take this advice, the harder it makes it for a magistrate to find against them because such a record is also the contents for an appeal or a set aside at least.

Here Here, I fully concur and about the Record Of The Parties, have been doing this all along. Some posts i have stressed this very fact more then enough! Always write "This Legal notice adds to the Record Of The Parties" toward the end of your notice.

here's how & why!

Thx LL,

much appreciated, have sort of followed lawful rebbellion but have been concentrating on other things.

Section 61 of magna carta I thought had been revoked but this changes that.

It i think should be obvious to all bring back Common Law in FULL
