In daveiron's new letter no 1) for debt purchasers there is a list of information requested.

My question relates to section 7):  "A signed statement that the Original Agreement did not create the credit, thereby making me the creditor"

What exactly does this mean please.  

To a layperson like me it sounds confusing - can it be re-written somehow in more plain English?

H joe,

Its your signature on the document that creates the credit,its standard banking practice of money creation.
Banks are not allowed to lend customers deposits .
There is no need to rewrite that part ,they know very well what you are asking for.

Suggest an affidavit might be better to ask for.

With an affidavit, you can screw them good and proper if you ever found out that they lied in an affidavit.

I know; the chances of finding out they lied are remote but it does put pressure on them to be careful about what they claim and it may peg them back a bit.

Compare an affidavit with a 'signed statement.' Is a signed statement nothing more than a signed statement, a Declaration, a Statutory Declaration or none of the above?

An affidavit is a "statement of truth" ones credibility and wealth is on the line, especially if made with 'full commercial liability."

I will start changing the letters later when I have a bit more time.
Although its one of the questions they always forget to answer (wonder why?)

From time to time I get asked for template letters that can be filled in & printed off.

whilst this may be convenient and time saving ,it results in nothing being learned .
The letters have been formatted in this way so it is necessary for the sender to type
and therefor read and hopefully understand what they are sending.
It should be remembered that it may end up in court & if you have no understanding of
what you have written ,you will have no chance of a win.
Should anyone not understand & want clarification please ask , its what we are here for.
