Just received a response from Moorcroft that they are handing my account back to HSBC. This is not without lecturing me on how I must not listen to ‘websites’ re: these kind of letters and how they urge me to seek legal advice. How caring of them! 😂

Thank you for helping me with getting them off my back.

Oh yes, I was meaning to ask, HSBC received all of my three letters and, as expected, no response. I was wondering, should I now leave it and await their next move, or follow up with further communication like Estoppel?

Hi , What you need now is a final Notice. Look at the 4th notice for
debt purchasers ,you have a choice of 2 ( just tweek for OC)
As you will see under the principals of equity as they have not responded
you can now answer for them.

Dear all. I was wondering if I need to do anything about this… HSBC sent me a ‘ Final Demand’ for the alleged loan. They have offered me a discount of over £2000 if I repay it by 13th of June. They have received all the letters from me in timely manner with zero response/ acknowledgment. Thoughts?

Hi Trishiapp, As always the choice is yours. Why would they offer a discount
if they could provide proof of claim ?
Remember you have acted in honour ,and have not refused to settle any
obligation.They have put themselves in dishonour by repeatedly failing to
rebut.

You should now have them in a tacit agreement by aquiescence.

I would finish it off with notice 4. you will find it here;

You will need to tweek it for OC & not for DPs. but i know you have done
your research and it wont be a problem for you.

there is a choice of 2 if you chose the affidavit just check you are sure how
to write one correctly .

Yes, I did send the fourth notice to which I had no reply to. In fact, I’ve not received as much as a single acknowledgment to any of my corespondents. I feel that, at this point, I’ve done all I can and , like you said, I have acted in honour. I don’t feel that it’s my job to draw their attention to my previous communications which wer duly ignored and am going to wait & see what their next move will be.

Agreed with DaveIron. Makes you ‘laugh’ when they offer discounts on non-existent (because there is no legitimacy ie real evidence) debts….

They do this for one reason and this is very basic psychology at its worst and the reason they do it is to get you to admit to an alleged debt by actions; there are two ways to admit to any alleged debt and that is orally or in writing where you admit to the alleged debt, or you undertake an action to acknowledge debt the and link it to the name and this is their sole objective and coming this far they know it is unilkely you will admit to an alleged debt and it is sheer desperation that you will give them something and at this state they will accept desperate and any mistakes on your part.

Assassin makes a very good point that everyone NEEDS to fully comprehend. It also has an impact on the statute barred ‘clock’ (5 years Scotland, 6 England and Wales) i.e. the moment you acknowledge a debt, it resets for another 5 or 6 years, respectively, even if there’s a only single day left from the original 5 or 6 years…

HSBC sent me an email telling me that they are investigating my ‘complaint’ and would like me to contact them to discuss. Of course I won’t be doing such thing, but they just popped out of nowhere so I thought that I will share.

This is another consensual action and by contacting them you are consenting to "business" and as this is about an alleged debt then they will use this as evidence of you acknowledging their alleged debt. The complaint route is just another way of getting you to contact them and it will be presented as you contacting them to deal with your alleged debt.

Good afternoon everyone. Hope you’re all keeping well and healthy.

I thought I will share a little update. So, after few months of peace & quiet, out of the blue, today, I received a letter with a cheque attached for the unfair fees and other nonsense they came up with they feel I need to be refunded for. How generous of them, LOL! Of course I know this is their silly attempt at getting me to cash it in, but must admit, it made me laugh!

Mind you, if there was a way of cashing it in without actually getting connected to them, I would happily do it as I could use the £500 they are offering. LOL.

Dear all.

As I’ve been dealing ( so far successfully) with the HSBC I completely fell on another matter, which is a PayPal alleged debt of just over £1000. Truthfully, I ignored Lowell’s letters thinking that , for such a small amount, they will just go away.  Well, they didn’t.

Today I’ve received ‘ Notice of Acting’ letter from Overdales Solicitors, I understand they are one & and the same as Lowell’s.

I understand my failing and, I guess, my ignorance in thinking I can just ignore them for such a small amount - mistake I shall not make again!

Stupidly I’ve not sent the three letters to Lowell and will get on it today. But I really need to stop Overdales from filing a claim with County Court so need urgent assistance.

To add, PayPal assigned to Lowell Portfolio back in Feb & then instructed Lowell Financial. They occasionally sent me letters which I stupidly ignored, and moved it onto Overdales. I take full responsibility for not dealing with this, but really need to stop them in their tracks before they file claim. In the ‘ Notice of Acting’ they say:

“We are instructed to initial legal proceedings against you unless you pay the (amount outstanding) in one off payment or under an agreed payment plan.

If you fail to make a payment or contact us to resolve this matter, we are instructed by our client to request that the court issued a County Court Claim against you. If legal proceedings are issued and you do not make payment following receipt of the court papers, or otherwise respond to the Claim, a CCJ enters against you. “

No time frame but I’m assuming they will move fast.

All done. 👍 Credit Agreement request sent to Overdales with £1 postal order enclosed ,as well as, 1st of my letters to Lowell . If they want me to go to court, I will, but first proof of this alleged debt! This lit fire under my belly!
