I am asking the above for a dear friend of mine who was day dreaming at the time of the said offence . A person who never breaks the rules and genuinely did not realise that one she was doing 80 mph and that also she was doing 80 mph in a 40 mph zone . She is afraid that she will lose her license and that would mean loosing work as she lives in the countryside and needs her car to travel to work Thank you in advance for any help .

Hello Every one of you ,
My friend has put this letter together and she asked me if it is ok . Well I don't know was my answer , but I will post it on the forum just in case that someone would be able to give advice . Thank you in advance of any useful advice regarding her situation .

For the attention of The Magistrate/ The Justice Clerk

I have received a document through the post stating that Jane JONES ( Not the real name but the surname all in capitals ) has committed an offence. I would like to question the validity of this document as there seems to be errors in the grammar and errors on a court document would of course render it null and void. To help me with this, I put to you these questions:

1) In which language is this document written? If English, please note which Styles Manual you have used to guide you with the grammar and font as I do not recognise the upper-case font as the English language.

2) If the upper-case text is not of the English language, could you please inform me if there is jurisdiction between two languages on a court document?

3) If “JONES” is not a word but an acronym, could you please tell me what it stands for?

4) Why are there two slight versions of the court address on the document and why are you using the Post Code B4 6QJ for one version when this post code is listed as “no longer in use” when I search for it on the internet? See attached evidence.

5) Do you have a contract with the implied company JANE JONES ( not the real name )? If you do, I oblige that you furnish me with a copy of that contract.

Just a quick one, hopefully you and your friend are switched on enough not to say either of those in writing or verbally to the court. All too often we see people setting out what they see as mitigation, but which could actually be interpreted as aggravation. It's helpful to think about what's said/written and think about if and how it could be twisted and used against you.

By the way it's interesting that they've gone straight for a summons.  Guidelines for that excess are either 6 points or a ban of up to 56 days, but normally there'd be a SJPN first meaning you get two shots at avoiding the ban.  Does she have existing points?  Did she pass her first driving test less than two years before the date of alleged offence?
