The Deed of Assignment is basically, the assignor (original creditor) formally assigning the rights and benefits of your debt to the assignee (debt purchaser).

The Notice of Assignment is the notice sent to you the debtor, that the assignment has taken place.

Reference Section 136 of the Law of Property Act 1925.

A notice of assignment is just one page notifying you of the assignment as stated above.

The deed of assignment has loads of pages and data on it, and may include acc statements etc. However, much of what you get is redacted for "commercially sensitive" reasons. It includes info on what they sold the debt for, but you will not see that.

I always asked (in any defence I wrote) for how much they had paid for the debt, especially, if they commenced proceedings and were claiming statutory interest against the full amount, why would they be entitled to SI in full if they didn't pay that much for it.

They can claim commercial in confidence but you can request the Court order its disclosure, for some reason they don't appear keen on that !

Tiggy, good point. How can they justify "LOSS" if they don't declare what they have lost. I don't see "opportunity loss" as real loss. ie what they intended to make as profit when they bought a debt cheaply.

Actual loss IS what they paid for it.

It would be very interesting if any court has actually ordered a debt collector to reveal what they have actually paid for the debt. This is usually bought as a "bulk" transaction, and it would be even more interesting if a debt collector reveals what they have actually paid.

They could shift the goalposts at any time and "hike" up the real debt on any particular debt. The only way to catch them out if they disclose:
1) The bulk payment for a load of debts.
2) What they have paid for the whole lot and the amount of the individual debt in court.
3) apportioned pro rate to each individual debt.

I cannot see a court ever agreeing to this.
