Local council ,reminder of Lord Justice Munby speech

I think this would be worth keeping as a reminder to local authorities who
increasingly act as masters and not as the servants that they really are.
Whilst this speech was made in regard to welfare issues, I believe it non the
less equally well applies to all council services.

Lord Justice Munby
" The local authority is a servant not a master,a truth which on occasions is too
easily overlooked.
Vulnerable adults and their carers,look to the state-to a local authority-for the
support,the assistance and provision of the services to which the law,giving effect
to the underlying principles of the Welfare State,entitles them.
They do not seek to be "controlled" by the State or by the local authority,and it
is not for the State in the guise of a local authority to seek to exercise such control.
The State, the local authority, is the servant of those in need of its support and
assistance; it is not their master,and any attempt to control is likely to be nothing
but counter-productive when it comes to a local authority 'working together'
as it must, with family carers".

Beware of Mumby and anything he says, those comments might seem like he is talking the truth, but this guys job is to make it look like the system he presided over can be trusted, the same goes for Lady Hale who talks about the dangers of the totalitarian state, yet brenda was one of the commissioners behind the 1989 Childrens Act when working for the Law Commission, along with a closet of feminist Academics and subversives .... that Act is one of the most devastatingly totalitarian acts of Paliment ever passed into law... which made every Birth Certificated child devoid of natural paternity and subject to the Parens Patriae of the Court ..... nothing Totalitarian about that is there.

I am aware of who and what he was ,being in charge of the Family law division
and all the evil that goes with it.
My point is what he said in that speech is true and should be used to our advantage.

I agree with your point absolutely, but those comments are made as mere advisory dictum for the public relations exercise, and have no legal force on their own, finding the same words in a legislated Act or Incorporating Memorandum certainly would carry some weight.

Now there is an idea, if anyone fances writing to the incumbent President of the Family Division to get a more weighty explanation per Mumby's comments ...

The other things is that Mumby restricted his ramble to LA's per care services, what is more pervasive is MAPA - Multi Agency Partnership Agreements, where the the SS, Police, EA's and GP's etc work in conjunction to utterly control and direct people who they are supposed to serve, Has any one read the Bridge's latest post ? Revealing.
