Hi all

Just a few thoughts that came to me while thinking.....

Dwelling - think 'human body', yours is being used for 'other than living purposes only'.

Individual - indivisible duo = body (land!) + mind/spirit

Resident - is your body identified as 'res'.

Who owns your home/car/children etc? - your estate.

Human = body = res = trust corpus = public = state = RES PUBLICA !

i would suggest perhaps reading this entire thread again with this info in mind, i guarantee an 'aha' moment.....

Greetings

This thread really is an education for the historical background of the council tax.

Thanks to some excellent contributions from FM, Candor, Waffle and others it is also a clue how to challenge it.

Here are some more up-to-date definitions of words and terms we were having difficulty with, now using 'HOUSE-NAME' instead of 'ESTATE'/SURNAME.



Hereditament - this refers to a human male 'person' and everything he has control over.

Heredit = Ancestral lineage (aka 'HOUSE-NAME') assets.

Ament = A-ment = no mind = idiot

Hereditament = HOUSE-NAME property/chattels of an idiot. Basically a human male and everything he controls including his wife and children. (a 'Mr')

Dwelling = unmarried female 'person' (a 'miss').

Domestic = HOUSE-hold servant, married female person (a 'Mrs'). (Possibly a full-time mother)

Non-domestic = a 'person' not subject/liable to a HOUSE-NAME, eg a student, a 'private' person, a living soul (man), a Christian.

Residential = 'res'-identity = HOUSE-NAME

Business = Family = HOUSE(of slaves)NAME

Rates = Raids

......Remember this? --

"Property is Domestic if ....... it is used wholly for the purposes of living accommodation"

Unless i'm very much mistaken that phrase is referring to a

HOUSE-wife ! (Possibly a full-time mother.)


i think someone is bound to work it out now......

Thanks for advice and wishes mate.

Doesn't seem to be much about the mags on here...except this thread, which is top draw, but are we still all thinking about what card game is being played then trying to find a good hand? Applied to...the legal system...in entirety.
Their system is so f#*@in twisted and corrupt, and there is so much learned wisdom on here, and here and there on the net. Seems to me, Them, are collective, established (over centuries) and therefore organised. Us, are... clawing at this and that with ideas, suggestions and results here and there. So Us have to work through, gather our dudil, organise the card hand then....bottle it or play them!

Them and their ways seem to be well documented by some of Us. And most of Us are, or have all been in the same boat... or water in our individual boats, paddling in the best direction that feels right at the time! So, as lots of Us now know about Them and the way their system is and Us, well we have the internet (save any puns with boats/water) and can do...stuff...fast...how do we turn in the same direction with the Us collective knowledge and wisdom and become an organised...pool of wisdom. (We don't want any animal farm, quite the opposite. Magna Carta and common law is all. Under God, man/woman, barons,/sovereign, sovereign subjects.... upholding "fair" justice for the man/woman who were put here by God!)
Because, Them seem to be ramping up their brainwashing and methods of control and as some of us know...Them (Them that are controlling almost everything) do not give a shit about Us...Them at the top seem to have an agenda...to break us...I'll heath, debt slavery, weather and crop manipulation...where's this path going, population decrease! Well, who's pulling the strings in all this? Or should i say, who owns...the banks, fuel, pharmaceuticals, controlling governments, etc....?

Back to Kublai khan...how do Us stand United?
Hopefully food for thought, and only my opinions.

Is there is a tool (Veronica Chapman's (and the yt link) makes lots of sense...if that's fact what can Them do, as long as Us know inside and out what it means to be the executor of our estate) that will work?
And, why should it matter at what stage of "legal" proceedings the tool is used?

magistrates court=money [usually the defendants]
[THE BAR]a criminal organization dating back to the knights templers
they like to refer to themselves as courts of administration.=fraud

2]The higher courts.?
Even when a case is a proven fraud...ie mortgages
will always..always judge in favor of..THE PUBLIC INTEREST=FRAUD

THE PUBLIC INTEREST=ENERGY.=the trustee
To sum up in as few words as possible.
A QUASI CRIMINAL ORGANISATION.
Who do not follow there own rules.
some liken a courtroom as a game but,one must
play by the rules in a game..umm.?

ie.you beat them in court..THEY judge you in absentia.

So in my opinion [don`t get court]
DEAL WITH THE MATTER before the second threatogram.

thank you...it is all very SHOCKING!

the bottom line seems to be (if the judgement is passed and the defendant is "guilty"/bailiffs knock) there is nothing we can do... And have to pay up?
So, what is the outcome likely to be if a bailiff turns up, after a reasonable conversation it is determined that the "defendant" cannot pay and has no "goods" to pay the "fine"?

At what point in "their" system will a defendant lose his/her ability to claim his inalienable rights?

1] there is no judgment in an administrative court they deal with PERSONS.
the MAGI normally rely on the clerk of the court for advice.

the MAGI rely on a points book for costing/thievery[sentencing]

PERSONshave duties benefits,and privileges...which can be
removed.=what people think of as THEIR name is actually a trust
which can be administered by CONSENT.

Seems there have been many omissions to The Magistrate Court Act 1980 on 4th Feb 2019 https://www.legislation.gov.uk/ukpga/1980/43/contents but it could be worse now that there are so many Amendments linking here there and everywhere!
What do you guys make of it?

The legislation ukpga – i assume is UK Public General Acts?

i searched for liability order in that section and also for “liability order” in All legislation – nothing obvious came up. So, what is a liability order?

How to deal with the liability order? Seems first they have to prove what one is, then how they can grant one.

Is it worth all the effort trying to “defend” or go for:

1. As per the Veronica letter on page 3 of this post.

So, what is a liability order? How can it be enforced?
If a liability order is received what do we need to know/require?


Suggested letter....any help is greatly welcome

To head of Birmingham mags (anyone know who this is? Would it be on companies house or D&B? - CEO?)

1. I require you tell me in legislation:
a, What a Liability Order is.
b, Where a man or woman is subject to an order to pay money.

3. I require:
a, A copy of the sworn statement by the (Authorised Assistant to the) Justices' Clerk.
b, Proof of the debt, evidence that the claimant has paid out funds.
c, Accounts showing all payments hitherto made by the claimant.

4. I require that the Clerk who issued the summons provides me with their documentation to show they scrutinised the sworn statement provided by an employee of the claimant, in accordance with Justice Clerks Rules 2005 (S.I.2005 No.545).

5. I require that you cease further actions from any bailiff forthwith.

These are original questions asked, the reply from the court Case Preparation was "Please advise Mr XXXXXXX to seek independent legal advice as to how to appeal the decision made by the magistrates’ court. There are no grounds to warrant the matter being re-listed back in the magistrates’ court."

I respectfully request to appeal the Liability Order and have the following points/requests if you can please oblige or advise where you can't:

1. I have not seen the liability order, only two letters from claimant claiming a Liability Order has been granted along with what appear to be photocopies of said Liability Order and a page offering financial advice on how to make payments. nb...offering financial advise is illegal I believe

2. I have no legal proof that there is a debt owed. There are discrepancies on the amounts that are allegedly being claimed. I wish to request:
a, A copy of the sworn statement by the (Authorised Assistant to the) Justices' Clerk.
b, Proof of the debt, evidence that the claimant has paid out funds.
c, Accounts showing all payments hitherto made by the claimant.

3. That the Clerk who issued the summons provides me with their documentation to show they scrutinised the sworn statement provided by an employee of the claimant, in accordance with Justice Clerks Rules 2005 (S.I.2005 No.545).

4. As a matter of urgency, a letter dated 22nd Jan 2019 was posted through the door, from an enforcement agent: Andy Carlton of marston holdings. He states he will be back within 10 days if he is not contacted to remove goods. Would you advise him that you have received this email? Please confirm if you will do this. His number is 07946 501538. Their reference # XXXXXXXXXX.

5. I contacted the court before the hearing (please see email below) and would like to ask why the adjournment was not granted?

Quite interesting, https://www.legislation.gov.uk/uksi/2014/600/made?view=plain
lots of mention of "person" however seems that a person after amendments is now a "debtor" (or "enforcement agent") many definitions including "a person, country, or organization that owes money", can't find anything specific in legislation.

Can anyone shed light on this?
What would be the best course of action against a liability order?

The definition of 'person' should be defined in the definitions section of this law.

if its not there is likely to be another law that is basically a legal dictionary for the laws in force at that time.

In my jurisdiction, the word 'person' includes, among others, the word "individual" but nowhere in the definitions section of the law or, in the dictionary law, is the word 'human' or 'human being' mentioned.

person” includes (without prejudice to the provisions of the M45Interpretation Act 1978) an association corporate or unincorporate;

the unincorporate is i think the birth cert', meaning it does not indicate or mean man or woman (not you)!

i have found these definitions - which took no time to be fair, but indicate nothing to do with any [wo]man:
Unincorporate
(of a company or other organization) not formed into a legal corporation.
not included as part of a whole.
Oxford - take in or contain (something) as part of a whole; include, constitute (a company, city, or other organization) as a legal corpora.

An association that has no legal personality distinct from those of its members.
Examples of unincorporated bodies are " partnerships and clubs".
